A Hertford man threatened with the sack after he was photographed in the pub while off sick received more than £2,400 compensation.

Mr Graham claimed that his employer J Varney and Sons Waste Management Ltd dismissed him unfairly in that they did not follow the correct procedures for dismissal.

Mr Graham’s employer failed to follow the steps in issuing a warning. The company leaped to the final warning stage without giving him the opportunity to state this case this then lead to his leaving the company

The tribunal ruled that the law requires a company to put disciplinary and grievance procedures in place and ensure that they are complied with.

This is the minimum statutory procedure and if this is not followed, the dismissal will be automatically unfair.
